A home equity line of credit is revolving borrowing secured against your house. Rather than taking a lump sum, you're given a limit and draw against it as you need to during a draw period, paying interest only on what is actually outstanding. After the draw period ends the line enters repayment, and the balance amortises over the remaining years. It suits costs that arrive in stages - a renovation billed by phase, say - far better than a lump-sum loan does, because you're not paying interest on money that is still sitting in your account.

Why Texas HELOCs Behave Differently

Texas treats home equity borrowing as a constitutional matter, and a HELOC here is bound by the same section 50(a)(6) provisions as a cash-out refinance. Everything you owe against the homestead, the line's full limit included, has to stay within 80% of fair market value - and it's the limit that counts against the cap, not the balance you happen to be carrying. Lender fees are capped at 2%. The 12-day notice period applies before closing. And you may only take one such loan against a homestead in any twelve months, which means a HELOC opened this year forecloses a cash-out refinance until that period has run. Sequencing therefore matters more in Texas than elsewhere, and it is worth deciding which of the two you actually want before opening either.
